OPERATING REGULATIONS

WEBSITE PROVIDING E-COMMERCE SERVICES CVTOT.VN

 

I. GENERAL PRINCIPLES 

1. Operational purpose

- It is an online space that helps businesses and employers convey recruitment information to people who are looking for jobs, thereby reaching suitable candidates and meeting the company's human resource needs.

- It is an online tool that helps job seekers access relevant recruitment information and assists candidates in creating effective resumes.

- Job postings or recruitment information published on CVTOT must fully comply with relevant legal regulations and must not fall under any prohibited categories as stipulated by law.

- Job postings on CVTot must be conducted openly and transparently, ensuring the rights of job seekers are protected. 

2. Principle of operation

- Comply with relevant regulations under Vietnamese State law.

- Build, develop, and ensure a civilized and healthy online environment. 

- Prioritize consumer rights. 

- Adhere to the rules for protecting users' personal information. 

3. Website access address for target users

- Website address for job seekers/candidates: cvtot.vn

- Access address for job posters/employers: cvtot.vn 

II. GENERAL REGULATIONS 

- The website providing e-commerce trading platform services cvtot.vn is abbreviated as CVTOT. 

- Candidate/Job seeker: This is for those who are looking for a job or candidates who need to use CV templates on CVTOT.

- Employer/Publisher: This includes merchants, organizations, individuals, businesses, and headhunters who are looking to recruit and find suitable personnel for vacant job positions.

- Member: This includes both Employers/Job Posters and Job Seekers/Candidates. 

+ Members must register and provide relevant information initially, be officially recognized by the CVTOT Management Board, and be permitted to use the service. 

+ Members can create their own account to use the service. 

+ Members can post job advertisements in accordance with the standards and commitments of legitimate members as published on the platform. 

Services on the website: 

- Job postings are intended for employers/job posters seeking suitable candidates. 

- This target audience includes candidates who create CVs to apply for jobs or search for job information. 

III.  TRANSACTION PROCESS

1. Process for Job Seekers/Candidates

a. For profile creation

Step 1: Register an account

- Candidates access the website cvtot.vn, click on the "Register" button to register an account.

- Candidates fill in their email address to register an account and, by agreeing, click "I have read and agree to the Terms and Conditions and Privacy Policy of CVTot". Then click "Create account".

- CVTOT will send a verification link to the email address the applicant entered.

- Candidates click on "Set Password" to verify their registered email address.

- After entering the password, the candidate clicks "Complete".

- After completion, the screen will switch to a notification page. Candidates should then log in to access the website.

- After creating an account, candidates can log in to access and use CVTOT's services. 

Candidates select the "Candidate" option, enter their registered Gmail address and password, click "Save login information" for easy login in the future, wait for verification that they are not a robot, and then click "Log in".

Step 2: Fill in all the required information completely and accurately in the application form.

In the Personal Information section: Full name; Email; Date of birth; Gender; Phone number; Address.

In the Job Notifications section, if candidates wish to receive notifications, they can enter their information to register.

Step 3: Review the information and click "Save information"

b. Regarding the job search and application process

Step 1: Log in to your previously registered account. After registering an account and logging in, candidates should access the website cvtot.vn and select the "Log in" option.

- Candidates enter their registered email and password and click "Log in".

- After logging in, the system will return to the homepage displaying the logged-in account information.

Step 2: To find suitable job openings, you can use filtering tools to select jobs by location, experience, field, etc.

- Click on the "Find jobs" section.

- Enter the job description you are looking for, then click "Search".

Step 3: Find out information related to the job you are interested in: Job description; Experience requirements; Salary and benefits;

- Click on the job posting that interests the candidate to view the detailed information posted by the employer.

Step 4: Select the appropriate job and click the "Apply" button, choose a CV from your computer's database or select a CV saved on the web.

- Applicants should enter their full name and phone number, choose a CV from their computer's database or select a saved CV from the website to upload. Then, click "Apply" to submit their application.

The screen will display "You have successfully applied".

Step 5: Wait for a response from the employer.

c. For creating an online CV

Step 1: Log in to your registered account and access "Manage CVs".

Follow the login steps as described in section (b) above, then click on the "Manage CV" option.

- Candidates select the option "Create a new job application".

- There are two ways for candidates to create an online CV. Candidates can choose the method that best suits their needs.

Step 1: Create a new CV by selecting from the available CV templates on CVTOT. After choosing a suitable template, candidates will proceed to fill in personal information and other relevant information in the relevant sections such as Education, experience, etc.

 - After clicking "Create new job application" the applicant clicks on "CV Templates" to select their desired template. Then, click "Use CV template" to begin creating the applicant's CV.

- Create a new CV based on an existing PDF file on your computer (the PDF file must include personal information and relevant work experience). Then, CVTOT will "extract" the relevant information from the PDF file to create a complete CV.

Step 2: Once they have the information, candidates can customize their CV template.

Candidates should review and make any necessary edits or additions. Once completed, candidates should click "Save application" and download their CV to their computer.

Note: 

- Candidates using a trial account will only be charged for actions taken after the basic plan is exhausted. During the trial period, basic CV previews and information searches are free.

- When you register to create an account to upload candidate CVs to the website, you will immediately have access to this service: 

+ Create a single CV with the CVTOT logo attached;

+ Save a maximum of 5 tasks.

+ Received 01 job notification;

+ You can apply for a maximum of 5 jobs, and a maximum of 3 times for each position.

- After using up the Basic Package and Trial Package, candidates need to purchase the Pro Package if they want to use services such as creating CVs, applying for jobs, etc.

The services included in the Pro package are: 

+ Create unlimited CVs without the CVTOT logo;

+ There are no limits on the content of your CV.

+ No limit on job postings;

+ Use an AI assistant;

+ There is no limit to the number of times you can apply for a job;

+ Save an unlimited number of jobs.

(iv) Candidates who purchase the CV creation service package.

- On the CVTOT e-commerce platform, job applicants can register to use service packages to easily and quickly create and manage their resumes (CVs). The process of purchasing services, making payments, and establishing transactions is done entirely online through the CVTOT website/app system, ensuring transparency and compliance with current legal regulations.

- The e-commerce platform offers only one service package for candidates. This package includes:

+ No limit on CV creation;

+ Save your favorite jobs;

+ No content restrictions on CVs;

+ No branded;

+ Design your CV however you like;

+ Assisting job seekers in their search for employment;

+ AI Assistant;

+ No limit on job postings.

- How to purchase a service package:

Step 1: Log in to your Candidate account

- Candidates select "Candidate" as the login option, enter their login information including email address and password, and click "Log in".

Step 2: Purchase a service package

After successfully logging in, the screen will switch to the main page. Candidates should click on their account avatar and select "Upgrade Account".

After clicking "Upgrade Account" the screen will redirect to the service package purchase page. Candidates should click "Upgrade Now" to proceed to the payment section..

Step 3: Payment

- After clicking "Upgrade Now," the system will redirect to the payment page. Applicants must agree to the "Terms of Service" publicly available on the CVTOT website before making payment by clicking "I have read and agree to the Terms of Service." This agreement serves as an electronic contract between the user (Applicant) and CVTOT Joint Stock Company.

- Then click on “Checkout” to proceed with payment.

- Enter your card number or account number in the corresponding field and press "Next".

- Enter the OTP code and press "Next".

- The system will process the order within seconds and will notify you of success once the transaction is complete.

- Immediately after successful payment, the system will:

+ Send order/service confirmation email.

+ Update the service activation status in the user account.

- Additionally, users can review their service purchase history, electronic invoices, and order status in the "Account Upgrade" section of the system.

- When a candidate makes a payment to use the CV creation service package on the CVTOT website/app, the service agreement is established through an electronic agreement, specifically as follows: 

Service Agreement:

- Candidates must agree to the "Terms of Service" publicly available on the CVTOT website before making any payment.

- This agreement serves as an electronic contract between the user (Applicant) and CVTOT Joint Stock Company.

- Agreement is expressed through the action of clicking a confirmation (checkbox or button) at the payment step, in accordance with the provisions of the Law on Electronic Transactions.

Electronic orders:

- After payment is completed, the system will automatically record an online order, clearly showing: 

+ Transaction time

+ Purchased service package

+ Amount to be paid

+ Order number

The order is saved in the applicant's personal account and a confirmation is sent via email. This establishes the right to use the service and proves the transaction between the two parties.

Invoices and supporting documents:

- The system allows users to request an electronic invoice after a transaction.

- All transaction data is stored and secured in accordance with current regulations.

2. Process for Employers

a. Create an Employer account

Step 1: Register for an Employer account

- Employers access the website tuyendung.cvtot.vn and click on the "Register" button.

Enter your registration email address, select "I have read and agree to CVTot's Terms and Conditions and Privacy Policy," and then select "Create account.".

- After clicking "Create account," the system will send an account verification email. The employer should then click "Set password”.

- Next, the employer sets a login password for the account and selects "Complete".

After successfully registering an account, the employer will log in using the email address and password they just created.

Step 2: Fill in all the required information completely and accurately in the application form.. 

In the general information field: 

- Company name;

- Business registration number;

- Business field;

- Introduction to the company;

- Business License; 

- Contact email; company website (if any);

- Company address.

Additionally, employers can add information about the company office and social media.

Step 3: Review the information and click "Save information".

b. The employer posts the job advertisement

To use the job posting service on the cvtot.vn website, employers must provide all necessary information as requested and wait for the system administrator to approve and verify the request.

Step 1: The employer logs into their account.

- To log in, employers access the website cvtot.vn and select the "Login" option.

Enter your registered email and password, and click "Log in".

After logging in, the system will return to the homepage displaying the logged-in account information.

Step 2: On the homepage, click the "Post a Job" button.

The Job Posting dialog box appears. The employer fills in the information in the "Job Group" section and clicks "Post a new job" or "Use a previously saved template".

- Select "Continue" to begin posting the job.

Step 3: When you select "Post a new job" and "Continue," the screen will switch to the Job Posting section. Employers will then proceed to enter all the necessary information for the job opening.  

- The fields marked with an asterisk (*), the "Job Description" section, and the "Benefits" section are mandatory.

- Enter complete information related to the job position. The following information must be included: 

+ Name of the recruiting company;

+ Employer information;

+ Job title;

+ Industry;

+ Type of work;

+ Work experience level;

+ Work experience;

+ Job group;

+ Application deadline;

+ Work location;

+ Office;

+ Content of the job description for the position being advertised;

+ Benefits;

+ Salary; 

+ Special request

- After entering all the information, the employer clicks "Next".

- Ensure that the content of the job posting is clear, easy to read, does not contain spam, does not use abbreviations, and does not violate moral standards.. 

- After entering the information, the employer can preview the job posting or save it as a draft.

Step 4: post job advertisement

- After reviewing all the information in the job posting, the employer clicks "Post". 

- There will be two recruitment packages for employers to choose from:

+ Free plan: Allows posting up to 3 job openings;

+ Premium plan.

- Employers select the appropriate package and click "Post".

After clicking "Post" the post will be sent to the Admin account for review. The system will then display the message "Post request submitted successfully, your request will be reviewed within 24 hours."

Step 5: The information will be reviewed by the Admin and displayed on the website's homepage.

After the job posting has been approved by the CVTOT Admin team, the employer will receive a notification that the post has been approved and it will be displayed on the CVTOT website.

If the employer wishes to apply for an advertising service package for a job position, they should select "Advertising Campaigns" for the job position they are recruiting for.

After entering all the job posting information, the employer clicks "Next". The job posting will automatically be published on the cvtot.vn website, and the screen will display the available ad packages. The packages displayed here are those the employer has previously purchased but not yet used.

The system will display the package purchase screen. The employer selects a suitable Ads package, enters the desired start date for running the ads, and clicks "Continue".

After clicking "Continue" the screen will switch to the section for filling in information for the Ads posting. The recruiter fills in all the information and clicks "Run Ads."

Step 6: Manage posted tasks

Employers click on "Manage Jobs". Employers can then track the total number of candidate CVs, total views, total interest received, and other information.

Note: 

- Employers who start using the CVTOT service will be able to post 3 job openings for free. After using up these, employers are required to purchase the Pro service package in the "Account Upgrade" section.

- In addition, employers can choose to use advertising packages (Ads) on CVTOT to increase visibility and attract more suitable candidates in a short time. This is an optimal solution to help job postings reach the right target audience and improve application rates.

- To post job advertisements or purchase packages, employers must provide complete information in the "Account Upgrade" section and have it verified by a CVTOT staff member.

When an employer wants to post a job or purchase a recruitment package but their account is not yet verified, the system will display the message "You need to verify your business account to use this feature."

c. The process by which employers purchase service packages.

Step 1: Log in to your Employer account

To log in, employers access the website cvtot.vn and select the "Login" option.

Employers click on "Employer" enter their registered email and password, and then click "Log in."

- For Ads service packages

The recruiter selects "Recruitment Package" and then clicks "Buy Package".

- For the Basic Listing Package

Employers click on the profile avatar, select "Upgrade account," choose a suitable package, and click "Use now."

Step 3: Choose the appropriate package and make a payment.

Employers select a service package that suits their recruitment needs. Apply discount codes and credits (if applicable). Employers read and agree to the "Service Terms and Conditions" publicly available on the CVTOT website before making payment by clicking on "I have read and agree to the Service Terms and Conditions". This agreement serves as an electronic contract between the employer and CVTOT Joint Stock Company.

Select "Payment", enter your card number or account number in the corresponding field, and press "Next".

- Enter the OTP code and press "Next".

- The system will process the order within seconds and will notify you of success once the transaction is complete.

- After payment, the service package will be saved and summarized in the "Package Management" section.

3. For Website Administrators

The cvtot.vn website administration team implements a content moderation process for member-posted information to ensure compliance with current laws and regulations and the website's operating rules. For information posted by members (including but not limited to: personal profiles, job search information, skill descriptions, and shared articles), the moderation process is as follows:

a. Receive the posted content.

Once a member completes posting a news item, creating a profile, or submitting a shared article to the system, that content will be forwarded to the content moderation department of the administration.

After a user (candidate or employer) posts a job or creates a profile, that content is temporarily stored on the system in a pending approval state. When the employer edits the post, they will also have to wait for the Admin team to approve it before it can be displayed again on the website. 

b. Content review and evaluation

After the employer submits a request for job review, the system administrator will review the content, check its validity to ensure the post does not violate policies and meets language standards.

The administration department will:

+ Verify the validity and appropriateness of the information: recruitment content, personal information, job description, language used, etc.

+ Remove any infringing information: false, lacking transparency, offensive, violating moral standards or the law.

Once the system determines the job posting is suitable, it will send an email notification stating that the employer's post has been approved. If the post is rejected due to a violation, the system will also send an email notification along with the reason for rejection.

- After reviewing the application, the employer will decide whether to "Approve" or "Reject" the posting.

Content will be rejected if it exhibits any of the following characteristics:

+ Using vulgar, offensive, or untrue language;

+ Violation of the law or social morality;

+ Copying from other sources without proper attribution;

+ Illegally advertising, soliciting, or brokering;

+ Causing confusion regarding job titles, qualifications, and experience;

+ Involves unverified organizations or individuals.

This does not comply with the Operating Regulations, Terms of Service, and policies on the website. 

c. Feedback and processing of review results

If the post/profile is approved: the system will automatically change to the "displayed" status, and the content will be publicly available to Employers or Candidates.

If content is rejected: The administrators will send a notification to the Member including the reason for rejection and instructions for editing (if any).

Members have the right to edit and resubmit content for review.

d. Post-approval monitoring

Content that has already been displayed may still be hidden or removed if feedback is received from other users or if violations are detected after further review.

The administrators have the right to temporarily suspend a Member's account if they detect repeated or serious violations.

e. Monitoring user account activity

The administrators have tools to monitor user account login, posting, and interaction activities.

Accounts that violate the rules will be penalized:

+ Email reminders/internal alerts;

+ Temporarily lock/restrict management;

+ Permanent deletion if the offense is repeated or a serious violation occurs;

Account activity history is stored in the system for review purposes in case of complaints.

In addition, the administration panel can perform the following functions:

- CV template management: Administrators can edit the design, delete, or add CV templates on the website.

- Manage Premium packages:   

+ For Premium packages and discount codes, administrators can perform the following actions: add, delete, and edit.

+ For Job Ads, administrators can manage the overall number of jobs currently being advertised, view their activity status, start date, and budget.

- Business Verification: Administrators have the function to approve Employer accounts. In this function, administrators can manage the account name, business name, approval request date, and approval status of the business.

4. Delivery and shipping process

The website does not have an online ordering function; members must contact and negotiate directly with the seller:

- For Employers: cvtot.vn posts information about its job posting service. After employers choose a service package that suits their recruitment needs, they proceed to the contract signing and payment stage. Once payment is complete, employers can use the service.

- For Candidates: Candidates choose pre-designed CV templates from cvtot.vn and make a payment to use them.

All transactions are typically conducted directly between the two parties, without involving a third party such as a delivery person or shipping agent. Therefore, cvtot.vn does not establish its own shipping process.

5. Order confirmation/cancellation process;

The unique feature of the products offered on CVTot is "job information." The website does not develop online ordering functionality and does not apply the order placement, confirmation, or cancellation procedures used for regular goods on e-commerce platforms.

6. Return and refund process

CVTot was created to provide a platform connecting employers and job seekers. Because it does not offer online ordering or involve transactions related to product inspection, the website does not have a return or refund policy. Therefore, CVTot does not have a return and refund process like typical e-commerce sites.

7. Product warranty/maintenance procedures

Due to the nature of CVTot as a website allowing employers to post job openings and candidates to create CVs, CVTot does not have a product warranty/maintenance policy. Recruitment and transactions are entirely based on negotiations between employers and candidates through methods such as interviews, tests, phone calls, etc.…

8. Dispute and complaint resolution process

a. General principles for resolving disputes and complaints.

CVTot encourages all parties involved, including Employers and Candidates, to proactively resolve disputes and complaints arising during transactions through negotiation and mediation, based on respect for each other's legitimate rights and interests. If they cannot resolve the issue themselves, the parties may submit a complaint to the platform's administration for assistance.

We are not responsible in the following cases:

- Cases of force majeure or objective obstacles as stipulated by law.

- User behavior: We are not responsible for the behavior of other users, including copyright infringement, disclosure of personal information, or any other illegal activity. 

- Technical issues: Problems related to hardware, software, network, or other technical factors beyond our control.

We are exempt from liability in the event that the data processing system, software, signal transmission system, or equipment used by users of cvtot.vn experiences malfunctions, errors, attacks, viruses, malware, etc., or for any other objective reasons beyond our control.

Regarding any loss, damage (direct, indirect), liability, and costs arising from any cause of action not attributable to our fault related to the user's use of, or inability to use, the service.

All disputes will be resolved in accordance with the laws of the Socialist Republic of Vietnam. Complaints must be submitted to CVTot immediately after the incident occurs. CVTot will review each case and provide an appropriate solution.

b. Procedures for receiving and resolving disputes and complaints.

Step 1: All requests and complaints will be forwarded to the customer service department for processing. 

- Members can submit complaints to CVTot through one of the following methods:

+ Email: hotro@cvtot.vn 

+ Customer support hotline: 0766783968 

+ Send directly or by mail to: CVTOT JOINT STOCK COMPANY

- The complaint must clearly state: the complainant's information, the subject of the complaint, the details of the case, and any supporting evidence (if applicable).

Step 2: The customer service and technical departments will verify and check the data and content of the complaint.

Step 3: If the complaint is valid, the company will take steps to prevent and resolve the issue (delete data, lock related accounts, stop the infringing behavior).

Step 4: Notify users of the resolution results via email/phone/text message.

The deadline for checking, verifying, and providing feedback on the processing results is within 7 working days. 

If the person making the complaint or dispute agrees with the content and proposed solution, the complaint or dispute resolution process concludes. 

If the person initiating the complaint or dispute disagrees with the proposed resolution and requests a re-resolution, the request for re-resolution will be received by the Customer Service Department. The process repeats Steps 2, 3, and 4. At Step 4, if the member still disagrees with the resolution offered by the Customer Service Department, the person initiating the complaint or dispute has the right to file a complaint or lawsuit with the competent state authority in accordance with the law.

Step 5: If necessary, the company will coordinate with the competent state management agency to thoroughly address the issue.

* Measures to be taken against members who violate consumer rights: 

Depending on the severity, we will apply appropriate measures such as:

- Remove listings: For listings that violate the platform's regulations, contain false information, or show signs of violating the law;

- Warning: Send a warning to the account that has violated the rules;

- Account suspension/lockdown: for serious violations or repeated violations;

- Coordination with authorities: If necessary, we will coordinate with relevant authorities to handle the case and protect the rights of consumers and other stakeholders. 

c. Timeframe for receiving and processing applications

CVTot only accepts complaints submitted within 30 days of the incident occurring.

After receiving a valid complaint, the Management Board is responsible for checking, verifying, and responding with the results of the handling within 7 working days.

d. Responsibilities of the parties involved

The complainant has the obligation to provide truthful and complete information and is responsible for the accuracy of the complaint. 

The party against whom the complaint is made is responsible for cooperating, providing information, and offering explanations to clarify the matter.

The CVTot Management Board will act as an intermediary, assisting in resolving cases fairly and objectively, and protecting the legitimate rights of service users.

e. Resolving disputes through legal means.

If the parties are unable to successfully negotiate and settle the dispute themselves, or do not agree with CVTot's proposed solution, the dispute will be submitted to a court or arbitration center for resolution in accordance with Vietnamese law.

IV. PAYMENT PROCESS

⁎ Description of the Payment System: 

Payment is made through the VNPT EPAY connection system.

- The website connects to the VNPT Epay payment gateway via a secure API.

- When a user chooses to purchase a service package, the system will:

+ Generate the order ID and the total amount.

+ Create a digital signature (checksum) using the Secret Key provided by VNPT.

+ Open the VNPT EPAY payment page directly on the website.

- All data sent to VNPT Epay (amount, order code, digital signature) is encrypted and transmitted via HTTPS/TLS. 

- Secure payment data: 

+ The website does not process or store customers' bank card information, CVV, or OTP.

+ The entire process of entering card information and verifying payment is carried out directly on VNPT Epay's secure system.

+ The website only stores basic information related to the transaction: order code, amount, payment status.. 

+ All data exchanged between the website and VNPT Epay is encrypted using HTTPS/TLS..

- Payment process: 

(1) User action steps:

+ The user selects a service package → clicks "Payment".

(3) Payment result: After payment, VNPT Epay makes an API callback to the website, along with the following status:

+ 00 → Payment successful. 

+ Other codes (24, 07,…) → Payment failed or cancelled.

1. Payment process between Employer and Candidate

- CVTot is an intermediary platform connecting employers and job seekers. CVTot does not charge fees, does not participate in the payment process, or receive/transfer money on behalf of either party. Any financial obligations (if any) between employers and job seekers are mutually agreed upon and carried out by the parties outside the system.

- CVTot is not an e-commerce platform with payment intermediary functions. The website only provides an environment for parties to post information, connect, and communicate with each other.

- CVTot assumes no legal responsibility for the content of the agreement, work performance, or any financial obligations between the Employer and the Candidate.. 

- In the event of a dispute arising between the two parties regarding payment or performance of work, the parties are responsible for resolving the dispute themselves through negotiation or requesting intervention from the competent authority in accordance with the law.

- To mitigate risks, CVTot recommends that parties sign a written or electronic contract before commencing any work.

Risk Warning: 

Users should exercise caution when transacting and should not transfer money to the other party before fully verifying their information and trustworthiness. If any fraudulent activity is detected, cvtot.vn encourages users to report it immediately so that the Administration can take timely action.

2. Payment process between the Employer and the CVTOT Website Management Team

- CVTOT Joint Stock Company is currently implementing an online payment system through an intermediary payment service provider, VNPT Electronic Payment Joint Stock Company (VNPT EPAY) – an entity licensed to operate by the State Bank of Vietnam in accordance with the law.

- Payments on the e-commerce platform are processed through a secure connection with the VNPT EPAY system, allowing users to pay using domestic bank cards (ATM cards) registered for Internet Banking services. The payment process takes place entirely online, without storing users' account/card information on the CVTOT system, ensuring data security and safety.

- Currently, the website cvtot.vn uses online payment via VNPT EPAY and the process is as follows:

After the user has selected a suitable service package and proceeded to the payment step, apply the discount code and credits (if any). The employer must read and agree to the "Terms of Service" publicly available on the CVTOT website before making payment by clicking on "I have read and agree to the Terms of Service". This agreement serves as an electronic contract between the employer and CVTOT Joint Stock Company.

Select "Payment", enter your card number, and press "Next".

Enter the OTP code and press "Next".

The system will process the order within seconds and will notify you of success once the transaction is complete.

3. Payment process between Candidates and CVTOT Website Management

After the candidate selects "Upgrade account" and clicks "Upgrade now".

After clicking "Upgrade Now," the system will redirect to the payment page. Applicants must read and agree to the "Terms of Service" publicly available on the CVTOT website before making payment by clicking "I have read and agree to the Terms of Service." This agreement serves as an electronic contract between the user (Applicant) and CVTOT Joint Stock Company. Then, click "Pay" to proceed with the payment.

- Enter your card number or account number in the corresponding field and press "Next".

- Enter the OTP code and press "Next".

- The system will process the order in a few seconds and will notify you of success when the transaction is complete.

V.  ENSURING TRANSACTION SECURITY

CVTot is committed to building a transparent, safe, and efficient transaction environment for both employers and job seekers. To protect the rights of users, especially in transactions involving payments, the website management team implements the following mechanisms: 

1. Provide users with complete information before transactions.

Before making any payment, users (Employers or Candidates) will be clearly and fully informed of all relevant information regarding the service, including:

- Content, scope, and duration of service provision;

- Service prices, discount policies (if any);

- Applicable payment methods;

This information is publicly displayed on the website interface during the service package purchase process.. 

2. Mechanism for ensuring the safety and security of payment information.

In the event that payment information is altered, deleted, canceled, copied, disclosed, moved, or misappropriated, causing damage to users, CVTot commits to cooperating with payment providers, authorities, and relevant parties to investigate, handle, and provide appropriate compensation if the fault lies with the platform's system.

3. Mechanism for handling complaints and disputes related to transactions.

- Users can submit complaints related to issues during transactions (including payments) via email, hotline, or the contact function on the website.

- CVTot will receive, verify the information, and respond within a maximum of 07 (seven) working days from the date of receiving the feedback.

- In the event of a dispute, CVTot prioritizes resolution through negotiation. If no agreement is reached, the dispute will be brought before the competent authority for resolution in accordance with the law.

4. Measures to prevent risks and fraud.

- The website management team performs manual or automated review of information posted by Employers and Candidates to detect signs of fraud, deception, or misleading content.

- Users can submit information to the website's administration to report unusual behavior or violations of their rights on the platform.

5. Warnings and recommendations for users

- CVTot advises users not to share account information, passwords, or payment information with third parties.

- During the payment process, users need to carefully check the access link, ensuring that they are operating within the secure environment of cvtot.vn or a reputable payment partner.

VI. CONSUMER DATA PROTECTION POLICY

1. Purpose of collecting personal information

When you register for or use any of CVTot's Services, we may collect personal information necessary to identify you:

a. For Candidates:

- Collecting information such as email address; browsing history of cvtot.vn; devices used to log in to cvtot.vn; and the time of access to cvtot.vn when registering/logging in to an account..

- Email information is collected when candidates register to receive notifications.

- We collect the following information when setting up an account: Full name; Email; Date of birth; Gender; Phone number; City; Country.

- Gather information including: Full name; Phone number; Address; Education; Experience; Hobbies; Skills; Courses; Degrees, certificates; Publications, articles; A complete CV when you create a new job application or edit a previously created CV.

- We collect email addresses, phone numbers, and full names when candidates contact the website administration department to resolve any issues or make other requests. 

b. For Employers: 

- Collect the following information when the business registers an account to post job advertisements and verify its business account: Company Name; Contact Person; Email; Phone Number; Tax Identification Number; Business Sector; Company Introduction; Business License; Company Website (if any); Country; State/Province; and Head Office Address.. 

- We collect your email address, phone number, and name so that the employer can contact the website administration team to resolve any issues you may have or for other requests. 

- CVTot collects and uses information for the following purposes: 

+ Providing services: Performing the service functions you have registered for, including account management, job searching, application processing, and related features. 

+ Enhance the user experience: Analyze user behavior to improve features, provide relevant job suggestions, or customize content to your needs

+ Connect with employers: Share your profile and job search data with employers when you agree.

+ Identity and Qualification Verification: Verification of Employer accounts. Verification of educational background, work experience, and other relevant information to ensure the authenticity of the applicant's profile.

+ Communications and advertising: Sending notifications related to services, new job opportunities, event information, courses, and relevant news.

- In addition, we may use your personal information to: 

+ Detecting and preventing violations of the law.

+ Fulfilling legal obligations. 

+ Improve and develop new services.

2. Scope of information usage

The CVtot e-commerce platform uses the information provided by job applicants and employers for the following activities:

- Verify the identity of users when they post job openings or search for employment. 

-  Assess the candidate's suitability for the position and the employer's level of trustworthiness. 

-  Analyze the content of the candidate's profile to recommend suitable jobs. 

-  Analyze recruitment content to introduce potential candidates to employers. 

-  Provide services as requested by registered users at CVtot. 

-  Manage and operate the services provided on the platform. 

-  Proactively contact candidates and employers when issues arise related to the use of the service.

-  Optimized job opportunities for candidates and services tailored to specific needs. 

- Verify the educational information stated in the candidate's profile from relevant educational institutions or professional organizations. 

-  Handle requests arising during service usage, including complaints or reports of violations.

- Receive, investigate, and resolve user complaints related to the service usage process.

- Monitoring and improving the quality of service delivery on the platform. 

- Research and analyze the actions of researchers to improve services and develop new products.. 

- Detect and analyze fraudulent, forged, deceptive, or illegal activities.

- Protecting user accounts from unauthorized access or hacking. 

- CVtot only uses personal information for the purpose of identifying, assisting, and providing services related to trading activities on the platform. 

- In cases where requested by competent state authorities such as investigative agencies, prosecutors' offices, or courts, CVtot is obligated to distribute and provide member information in accordance with the law. Except in these cases, all user personal information is kept strictly confidential and will only be shared with the consent of the data owner.

3. Information retention period

Your personal information will be stored for the duration of your use of CVTot's services and for any legal or business purposes after you cease using the services. After an account is deactivated or terminated, CVTot will retain the information for a reasonable period for backup, storage, and/or verification as required by law.

In addition, if your account is inactive for 180 consecutive days, we reserve the right to delete your account and related data. 

4. Individuals or organizations that may have access to that information

- Members have the right to check, update, adjust, or cancel their personal information by logging into their account and editing their personal information or requesting CVTot to do so. 

- Members have the right to file complaints regarding the disclosure of personal information to third parties with the CVTot e-commerce platform's management board. Upon receiving these complaints, CVTot will verify the information, provide an explanation, and guide members on how to restore and secure their information. 

- We are committed to protecting your personal information through appropriate technical and administrative measures to prevent loss, misuse, or unauthorized access. 

- However, no security method is absolutely foolproof. In the event of any security incident, we will notify you immediately and work to resolve the issue.

- We will not use, transfer, provide, or disclose members' personal information to any third party without the member's explicit consent, except in the following cases: 

+ Employers: When you choose to share your profile to be found by employers.

+ Service Provider Partners: Companies or individuals that CVTot hires to provide related services such as background checks, data analysis, or technical support.

+ Authorized state agency: When requested by law enforcement agencies or to comply with legal regulations.

+ Stakeholders in mergers: In the event of a CVTot merger, acquisition, or bankruptcy, user information may be transferred to the acquiring party to continue providing services.

In all cases, CVTot will require third parties to strictly adhere to privacy regulations and use information only for agreed-upon purposes.

7. Mechanism for receiving and resolving consumer complaints related to the misuse or unauthorized use of personal information.

We are committed to protecting users' personal information and using it only for the purposes stated. If any personal information is found to have been used for purposes or outside the scope stated within the company, the company will be held liable according to the law. 

In the event that our information system is attacked, resulting in a risk of user data loss, the Company will notify the authorities and users within 24 hours of detecting the incident. 

If users discover that their personal information has been used for purposes or outside the scope announced, they should immediately file a complaint using one of the following methods:

The management team commits to responding to complaints immediately or at the latest within 24 business hours of receipt. The processing and response time is 7 business days. 

CVTot only accepts complaints submitted within 30 days of the incident occurring. 

* The process for receiving consumer complaints regarding the misuse or unauthorized use of personal information.

Step 1: All requests and complaints will be forwarded to the Management Board for reception.

The complaint should clearly state: the complainant's information, the subject of the complaint, the details of the case, and any supporting evidence (if applicable).

Step 2: The administration and technical team will verify and examine the data and content of the complaint.

Step 3: If the complaint is valid, the company will take steps to prevent and resolve the issue (delete data, lock related accounts, stop the infringing behavior) and respond to the complainant. 

Step 4: Notify users of the resolution results via email/phone/text message. 

If the person making the complaint agrees with the content and proposed solution, the complaint handling process ends. 

If the complainant disagrees with the proposed solution and requests a re-resolution, the request for re-resolution will be accepted. The process repeats Steps 2, 3, and 4. At Step 4, if the consumer still disagrees with the solution offered by the Management Board, the complainant has the right to file a complaint or lawsuit with the competent state authority in accordance with the law.

Step 5: If necessary, the company will coordinate with the competent state management agency to thoroughly address the issue.

The responsibilities of intermediary digital platform owners towards consumers are stipulated in Article 39 of the Law on Protection of Consumer Rights.

After the employer registers an account and uploads legal documents (business registration certificate) and tax identification number, the administration team will review the information and verify the employer's account by checking the tax identification number provided by the employer on the link provided by the General Department of Taxation: https://tracuunnt.gdt.gov.vn/tcnnt/mstdn.jsp

Only after valid verification with complete tax identification number and business registration certificate information matching the information on the General Department of Taxation's lookup page or the National Business Registration Portal, along with an active status, will the Employer be able to verify their identity and use the platform's features.

The above is the verification method that CVTOT is applying, ensuring transparency, enhancing the responsibility of employers, and protecting the rights of consumers.

VII. WEBSITE INFORMATION MANAGEMENT

1. General requirements for members

- Members are solely responsible for the security and safekeeping of all activities performed using the service under their registered username and password.

- Members are responsible for promptly notifying the CVTot e-commerce platform of any unauthorized use, misuse, security breaches, or unauthorized storage of usernames and passwords by third parties so that appropriate measures can be taken.

- Members are prohibited from using the CVTot e-commerce platform's services for illegal, unreasonable, fraudulent, threatening, illegal information gathering, sabotage, creating and distributing viruses that damage the system, configuration, and information transmission of the CVTot e-commerce platform, or using its services for speculation, market manipulation, creating fake orders or offers, including for the purpose of predicting market demand. In case of violation, members shall be held responsible for their actions before the law. Members are not allowed to alter, modify, assign, copy, disseminate, distribute, provide, or create similar tools of the services provided by the CVTot e-commerce platform to a third party without the consent of the CVTot e-commerce platform as stipulated in these Regulations.

- Members are prohibited from acting in any way that damages the reputation of the CVTot e-commerce platform, such as causing disunity among members by using a second registered name, through a third party, or by disseminating information that is detrimental to the reputation of the CVTOT e-commerce platform.

2. The mechanism for reviewing and controlling information by the E-commerce Platform Management Board regarding articles published on the website.

After a member posts a job advertisement, it will be pending approval. Only after approval will the advertisement be displayed.

CVTot reserves the right to remove content that violates the Terms and Conditions or legal regulations. CVTot is not responsible for third-party content and does not guarantee the accuracy of user content.

 * Mechanisms for controlling and reviewing information on websites.

The CVTot administration implements strict controls on information posted by Members (including Applicants and Employers) to ensure compliance with legal regulations and social ethical standards. Specifically: 

a. Control employer information.

Verify the employer's basic legal information when registering an account: business/individual name, tax code, address, business license.. 

Accounts that do not provide sufficient information or show signs of impersonation will be temporarily suspended or permanently blocked depending on the severity of the violation. 

b. Content control

Only content related to job recruitment and the provision of legal labor services in accordance with Vietnamese law is permitted to be posted.

Job postings for positions related to: prostitution, illegal brokerage, loan sharking, illegal multi-level marketing, gambling, betting, trading in prohibited goods, smuggled goods, counterfeit goods, and disguised services are not permitted. 

Regarding the review, prevention, and removal of inappropriate and violating keywords as recommended by state management agencies, the CVTOT system has compiled a list of violating and non-standard words and phrases and incorporated them into the code. If a recruiter's job posting (both the job description and the title) contains any of these words, the system will prevent the post from being published and display the error "Content contains inappropriate language. Please check and edit to ensure compliance."

c. Handling violations

 If the Management Board discovers that a Member has posted content that violates the law or the Operating Regulations, the Management Board has the right to: 

- Remove content immediately without prior notice;

- Accounts may be temporarily or permanently suspended depending on the severity of the violation;

Notify the competent authorities if the act shows signs of a criminal offense or an administrative violation.

* Review and address intellectual property rights violations.

CVTot respects and is committed to protecting the intellectual property rights of organizations and individuals. 

Intellectual property rights holders can submit requests for infringement handling (including authentic evidence of ownership and the infringing act) via the official email address of the Management Board: hotro@cvtot.vn. Within 3 working days, the Management Board is responsible for reviewing and verifying the information. If there is sufficient evidence, the content in question will be removed immediately and the publisher will be notified.

In cases where a Member is found to have repeatedly violated the rules, the Administration Board will permanently lock the account and provide the information to the competent authorities as requested.

* Regulations on information security and data management

- The CVTot website complies with legal regulations regarding personal data protection and cybersecurity.

- Implement technical measures, software, encryption, and internal monitoring to protect user information from unauthorized access, loss, or destruction. 

- Members are responsible for keeping their passwords and accounts secure and not sharing them with others. If any signs of unauthorized access are detected, please notify the administrators immediately.

- The storage, processing, and use of personal information are carried out in accordance with the Cybersecurity Law.

VIII. RESPONSIBILITY IN CASE OF TECHNICAL ERRORS

- CVTot is committed to ensuring that the technical systems, infrastructure, and software operating the website are stable, secure, and continuous. In the event of a technical issue, CVTot will proactively coordinate with technical departments to resolve it as quickly as possible, minimizing the impact on user rights. 

- In the event of technical errors on the website such as access interruptions, incorrect displayed information, transaction errors, etc., CVTot will publicly notify users through official communication channels and provide specific instructions on how to resolve the issue or re-execute the transaction if necessary.

- In the event of technical errors, software errors, or other objective errors that prevent members from participating in transactions, CVTot will proactively resolve the errors as quickly as possible using professional methods. When members discover technical errors, they should immediately notify the E-commerce Platform Management Board via hotline 0766783968 or email: hotro@cvtot.vn. We will resolve the errors as soon as possible, facilitating members' participation in using the service. CVTot encourages users to provide detailed information to support the process of handling and resolving issues effectively.

- CVTot reserves the right to temporarily suspend part or all of the services on the website for maintenance, repairs, or system upgrades. In such cases, CVTot will endeavor to notify users in advance, except in cases of force majeure or urgent situations. 

- CVTot is not responsible for indirect, special, or incidental damages arising from the interruption of website access or use due to unforeseen events such as power outages, internet connection failures, cyberattacks, natural disasters, epidemics, or the actions of third parties beyond CVTot's control. 

- CVTot is not liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use our services, including but not limited to: 

+ Local or widespread power outages can affect the ability of users' servers or equipment to operate;

+ Internet connection errors originating from the telecommunications service provider or due to technical issues beyond CVTot's control;

+ Malicious cyberattacks such as DDoS, viruses, spyware, etc., disrupt systems or compromise data;

+ Natural disasters, epidemics, fires, wars, riots, or other force majeure events as defined by law;

+ Unauthorized interference, operational errors, or violations by third parties are not under the management or control of CVTot.

IX. RIGHTS AND RESPONSIBILITIES OF THE E-COMMERCE WEBSITE MANAGEMENT BOARD CVTOT.VN

1. Rights of the Management Board of the e-commerce website cvtot.vn

- We reserve the right to charge service fees after the Candidate or Employer has read and agreed to the Service Terms and Conditions;

- We reserve the right to refuse, suspend, or terminate a member's access to the service if there is evidence that the member has violated the Operating Regulations, legal regulations, or while awaiting the final conclusion/agreement of the relevant parties, or for other actions that may harm cvtot.vn and other users. In the event of termination of access to the service in the above cases, CVTot will not refund the service fee paid by the member if the fault is determined to be the member's. In the event of termination of membership and access to the service, all rights granted to the member on CVTot will automatically become invalid and terminated.

- We reserve the right to require participating members to provide complete and accurate information and to be legally responsible for the information they provide.

- We reserve the right to change the service pricing and payment methods on cvtot.vn during the service provision period for members, based on the needs, conditions, and capabilities of cvtot.vn. We will notify members in advance of any changes.

- We reserve the right to change, modify, add, or remove any content from these Regulations after notifying users.

2. Responsibilities of the Management Board of the e-commerce website cvtot.vn

- Register and establish a website providing e-commerce trading platform services in accordance with the law and publish information about the website owner on the website's homepage.

- Develop and publicly publish on the website the operating regulations of the e-commerce trading platform; monitor and ensure the implementation of those regulations on the e-commerce trading platform.

- Require members on the e-commerce platform to provide information as required by law when registering to use the service.

- There should be a mechanism for checking and monitoring to ensure that the information provided by sellers on e-commerce platforms is accurate and complete.

- Store registration information of merchants, organizations, and individuals participating in the e-commerce trading platform and regularly update any changes or additions to the information.

- Implement necessary measures to ensure the security of information related to the business secrets of traders, organizations, and individuals, as well as the personal information of consumers.

- Take prompt action when detecting or receiving reports of illegal business practices on e-commerce platforms:

+ Block and remove from the website any information offering services that fall under the category of prohibited business activities, or belong to industries or professions prohibited from investment and business activities according to the law;

+ Remove information about services that violate the law within 24 hours of receiving a request from the competent state management agency;

+ Coordinate with intellectual property rights holders to review and remove products that infringe intellectual property rights according to the procedures and regulations published in the operating regulations of the e-commerce trading platform;

+ Warnings or refusal of services, either temporary or permanent, will be issued to individuals, businesses, and organizations engaging in business practices that violate the law.

- Assisting state management agencies in investigating and handling business practices that violate the law, and resolving disputes and complaints:

+ Provide information about entities showing signs or engaging in illegal activities on e-commerce platforms to competent state management agencies upon detection or receipt of such information;

+ Regularly update keywords according to recommendations from competent state management agencies and filter information by keywords before displaying information about goods and services on the website;

+ Receive and respond to information to resolve complaints, feedback, and disputes related to e-commerce platforms at the Ministry of Industry and Trade's E-commerce Management Portal at online.gov.vn.

- Publicly disclose the mechanism for resolving disputes arising during transactions on the e-commerce platform. When a candidate on the e-commerce platform has a conflict with an employer or their legitimate interests are harmed, the platform must provide the candidate with information about the employer and actively support the candidate in protecting their legal rights and interests.

X. RIGHTS AND RESPONSIBILITIES OF PARTIES PARTICIPATING IN THE E-COMMERCE WEBSITE CVTOT.VN

1. Rights and responsibilities of employers on the cvtot.vn website.

a. Employer rights on the cvtot.vn website

- Members can create accounts when needed and post job advertisements according to regulations.

- Employers can use the platform's enhanced features after paying the service fee according to the registered service package.

- The right to request the correction or deletion of personal information when necessary.

- The right to refuse the processing of personal information for advertising or marketing purposes.

- Entitled to technical support and information security when participating in the platform.

- Members have the right to contribute feedback to the e-commerce platform during its operation. Suggestions can be sent directly by mail, fax, or email to the CVTot e-commerce platform. 

b. Responsibilities of Employers on the cvtot.vn website

- Provide CVTot with complete and accurate information as required by law when registering for the service.

- Provide complete information about the service as required by law when providing services on the e-commerce platform.

- Ensure the accuracy and truthfulness of information about services provided on the e-commerce platform.

- Comply with legal regulations regarding payment, advertising, intellectual property protection, consumer rights protection, and other relevant legal provisions when providing services on e-commerce platforms.

- Members are solely responsible for the content and images of their business information and other information, as well as the entire transaction process with partners on the CVTot e-commerce platform.

- Do not use other people's accounts without permission.

- Participate in transactions in compliance with the Exchange Regulations and the provisions of the Privacy Policy and the Use of Personal Information.

- Members are responsible for promptly notifying the CVTot e-commerce platform of any unauthorized use, misuse, or security breaches involving their username and password so that both parties can cooperate in resolving the issue. Members commit that the information provided to the CVTot e-commerce platform and the information posted on the CVTot e-commerce platform is accurate.

2. Rights and responsibilities of candidates on the cvtot.vn website.

a) Candidate rights on the cvtot.vn website

- Candidates have the right to register a personal account on the CVTot website to use the services provided by the system.

- Candidates have the right to have their personal information and application data protected by CVTot in accordance with Vietnamese law on personal data protection. 

- Candidates have the right to access their personal accounts to view, edit, update, or delete personal information and application profiles at any time. If they are unable to operate the system, candidates have the right to contact CVTot support for assistance. 

- Candidates have the right to opt out of receiving promotional emails, job newsletters, or other unwanted content from CVTot through unsubscribe options integrated into each email or account settings. 

- Candidates have the right to submit feedback and complaints regarding service quality, inaccurate recruitment information, inappropriate behavior from the employer, or any issues arising during the use of the website. CVTot is committed to receiving and processing complaints as quickly as possible, in a spirit of cooperation and protecting user rights. 

- Candidates have the right to be clearly informed about the terms and conditions of service; their rights and obligations related to creating a profile and applying for jobs, as well as any legal obligations. 

b) Responsibilities of Candidates on the cvtot.vn website

- The information that members provide to the CVTot e-commerce platform must be accurate and complete. 

- Members are solely responsible for the content, images, and other information, as well as the entire transaction process with partners on the CVTot e-commerce platform. 

- Do not use someone else's account without permission. 

- Participate in transactions in compliance with the Exchange Regulations and the provisions of the Privacy Policy and the Use of Personal Information.. 

- Members are responsible for promptly notifying the CVTot e-commerce platform of any unauthorized use, misuse, or security breaches involving their username and password so that both parties can cooperate in resolving the issue. Members commit that the information provided to the CVTot e-commerce platform and the information posted on the CVTot e-commerce platform is accurate. 

3. Defining the responsibilities between CVTot Joint Stock Company and Employers in resolving issues arising from transactions conducted on the cvtot.vn website with Candidates.

a. Defining responsibilities between CVTot Joint Stock Company and Employers in resolving issues arising from transactions conducted on the cvtot.vn website with Candidates

The website cvtot.vn acts as an intermediary platform, allowing employers and candidates to connect, exchange information, and establish recruitment transactions. Issues arising from transactions between employers and candidates will be resolved by the following parties:

- All transactions arising between the Employer and the Candidate, including but not limited to: receiving applications, conducting interviews, signing employment contracts, agreeing on working conditions, salary, rights and obligations of both parties... are independent transactions, voluntarily established by the parties, and for which they are legally responsible. CVTot Joint Stock Company is not a party to or representative of any party in the execution of such transactions and is not responsible for the results, content, or legal validity of the employment agreements between the two parties. 

- The employer is responsible for resolving all issues arising from transactions established with the candidate, including: complaints related to inaccurate, unclear, or fraudulent recruitment information; compensation for damages (if any) in case of breach of the agreement with the candidate; and providing explanations and cooperating with competent authorities when required to investigate or handle the matter.

- CVTot is not responsible for directly resolving disputes between Employers and Candidates. However, the Company is responsible for: Receiving feedback from Candidates regarding violations by Employers; Providing technical information, transaction history, and related documents to assist in the investigation and verification process (if requested by either party or competent authority); Temporarily suspending, terminating, or suspending access for Employers showing signs of fraud, violating operating regulations, or breaking the law; Cooperating with state management agencies in handling violations, if any.

- In the event of a dispute, CVTot encourages all parties involved to prioritize negotiation and mediation in good faith. If an agreement cannot be reached, the parties have the right to file a lawsuit with the competent authority in accordance with the law. CVTot will provide support in its role as an intermediary, supplying information to facilitate the dispute resolution process.

b) Limiting the liability of merchants and organizations providing e-commerce platform services in transactions conducted on the platform.

Cvtot.vn is an intermediary platform connecting employers and candidates, helping employers find suitable candidates and utilize related services on the platform, but it does not participate in the process of concluding employment contracts between the parties. Therefore, we are not responsible for any actions and/or omissions of employers or candidates during the transaction process.

Employers and candidates mutually agree upon and are solely responsible for the terms of the transaction, the rights and obligations of each party in related transactions, and compliance with Vietnamese law.

XI. TERMS AND CONDITIONS APPLY

The CVTot e-commerce platform's regulations officially come into effect from the date of signing the Decision promulgating these regulations. The Terms and Conditions may be updated and amended without prior notice. Changes will be published on the website, and you must agree to the changes to continue using the Service. If any provision is declared invalid, the remaining provisions remain in effect.

XII. COMMITMENT CLAUSE

The CVTot e-commerce platform and its participating members agree to comply with all the terms and conditions in this Regulation.
