This Terms of Service constitutes a legally binding contract between the Member and CVTOT Joint Stock Company regarding the Member’s access to and use of cvtot.vn and related services.
By accessing, registering an account, or using cvtot.vn, the Member acknowledges that they have read, understood, and agreed to be bound by all terms and conditions set forth in this Agreement. If the Member does not agree to any of the terms, please do not use the services on our Platform.
- Website: The e-commerce marketplace website providing services at cvtot.vn, hereinafter referred to as CVTOT.
- Candidate/Job Seeker: Individuals who are seeking employment or Candidates who wish to use CV design templates available on CVTOT.
- Employer/Job Poster: Including merchants, organizations, individuals, companies, enterprises, and headhunters who have recruitment needs and seek suitable candidates for vacant positions.
- Member: Includes both Employers/Job Posters and Job Seekers/Candidates.
- Members must complete the initial registration and declaration of relevant information, which must be officially approved by the CVTOT Management Board before being permitted to use the services.
- Members may create their own account to use the services.
- Members may post recruitment listings in accordance with the prescribed standards and the lawful commitments publicly announced on the Platform.
Services on the Website:
- Posting job recruitment listings for Employers/Job Posters for the purpose of seeking suitable candidates.
- Candidates may create CVs for job applications or search for job-related information.
To use the Services, Members must create an account in accordance with CVTOT’s requirements. Members undertake to provide accurate, complete, and up-to-date information. The rights and obligations of Members are based on the registered account information. CVTOT shall not be liable for any issues arising from inaccurate or false information.
Members must keep their passwords confidential and must not share them with any third party. If there is any suspicion that a password has been compromised, the Member must immediately notify us via email at hotro@cvtot.vn. CVTOT reserves the right to require a password change or to temporarily suspend the account if there is any suspicion of security breaches.
Members shall be responsible for any damages arising from the loss of their password or the improper use of the Website.
When using the Website, Members agree that CVTOT has the right to collect and store the Member’s personal information and profile data. CVTOT may use such information to provide services and to recommend products and services from third parties. CVTOT may also comply with legal requirements and disclose user information when necessary.
If Members do not wish for their personal profiles to be made public, they may disable the job-seeking feature and prevent Employers from viewing their profiles. CVTOT reserves the right to delete accounts and related information after a prolonged period of inactivity, and Members must obtain CVTOT’s consent in order to restore such information.
Members represent and warrant that they own or have the right to grant the necessary rights and licenses for the content they upload, and that such content does not infringe the rights of any third party. CVTOT owns all rights to its services and CVTOT content. Members shall not copy, modify, or exploit CVTOT content without prior authorization.
CVTOT reserves the right to remove any content that violates these Terms or applicable laws. CVTOT shall not be responsible for third-party content and does not guarantee the accuracy of user-generated content.
We shall not be liable in the following cases:
- Force majeure events or objective obstacles as prescribed by law.
- User conduct: We are not responsible for the actions of other users, including but not limited to copyright infringement, disclosure of personal information, or any other unlawful acts.
- Technical issues: Problems related to hardware, software, networks, or other technical factors beyond our control.
- We shall be exempt from liability in the event that data processing systems, software, signal transmission systems, or devices used by users to access cvtot.vn experience malfunctions, errors, attacks, viruses, malware, or any other objective reasons beyond our reasonable control.
- Any losses, damages (direct or indirect), liabilities, or costs arising from any cause of action not attributable to our fault in connection with the user’s use of, or inability to use, the Services.
The allocation of responsibilities between CVTOT Joint Stock Company and Employers in resolving issues arising from transactions conducted on the website cvtot.vn with Candidates.
The website cvtot.vn/en operates as an intermediary platform that enables Employers and Candidates to connect, exchange information, and establish recruitment transactions. Any issues arising from transactions between Employers and Candidates shall be allocated and resolved as follows:
- All transactions arising between Employers and Candidates, including but not limited to the receipt of applications, interviews, execution of employment contracts, agreements on working conditions, salaries, and the rights and obligations of each party, are independent transactions voluntarily established by the parties and for which they bear full legal responsibility. CVTOT Joint Stock Company is not a party to, nor does it represent any party in, the performance of such transactions, and shall not be liable for the outcomes, contents, or legal validity of any recruitment agreements between the two parties.
- Employers are responsible for resolving all issues arising from the transactions they establish with Candidates, including: complaints related to inaccurate, unclear, or potentially fraudulent recruitment information; compensation for damages (if any) in the event of a breach of commitments made to Candidates; and providing explanations and cooperating with competent authorities when required for investigation or handling.
- CVTOT shall not be responsible for resolving direct disputes between Employers and Candidates. However, the Company has the responsibility to: receive reports from Candidates regarding violations committed by Employers; assist in providing technical information, transaction history, and relevant documents to support investigation and verification processes (upon request from either party or competent authorities); temporarily suspend, restrict, or terminate access rights of Employers showing signs of fraud, violations of operating regulations, or violations of law; and cooperate with state authorities in handling any violations, if applicable.
In the event that issues arise, CVTOT encourages the involved parties to prioritize negotiation and amicable settlement in good faith. If no agreement can be reached, the parties have the right to initiate legal proceedings before competent authorities in accordance with applicable laws. CVTOT will provide support within its role as an intermediary by supplying relevant information to facilitate the dispute resolution process.
Limitation of Liability of Merchants and Organizations Providing E-Commerce Marketplace Services in Transactions Conducted on the Platform
The website cvtot.vn/en serves as an intermediary platform connecting Employers and Candidates, enabling Employers to search for suitable Candidates and use related services on the Platform, and does not participate in the process of entering into employment contracts between the parties. Accordingly, we shall not be responsible for any acts and/or omissions of Employers or Candidates during the course of such transactions.
Employers and Candidates shall independently negotiate and bear full responsibility for the transaction terms, the rights and obligations of each party in the related transactions, and compliance with the laws of Vietnam.
All disputes shall be resolved in accordance with the laws of the Socialist Republic of Viet Nam. Complaints must be submitted to CVTOT promptly after the event giving rise to the dispute. CVTOT will review each case and propose an appropriate resolution.
If the dispute is not resolved within sixty (60) days, the Member has the right to bring the matter before a competent court in Hanoi City. The losing party shall bear all litigation costs.
- We have the right to charge service fees after Candidates or Employers have read and agreed to the Terms of Service.
- We have the right to refuse, suspend, or terminate a Member’s right to use the Services if there is evidence that the Member has violated the Operating Regulations, applicable laws, is pending a final conclusion or agreement among relevant parties, or has engaged in other actions that may cause harm to cvtot.vn and other users. In the event that the right to use the Services is terminated under the above circumstances, CVTOT shall not refund any service fees already paid if the fault is determined to be attributable to the Member. Upon termination of membership and service usage rights, all rights granted to the Member on cvtot.vn shall automatically become null and void and be terminated.
- We have the right to require participating Members to provide complete and accurate information and to bear legal responsibility for the information they provide.
- We have the right to change service pricing and payment methods on cvtot.vn during the service provision period based on the needs, conditions, and capabilities of cvtot.vn, and shall notify Members in advance of any such changes.
- We have the right to modify, amend, add, or remove any content of these Regulations after providing notice to users.
- Register and establish the website providing e-commerce marketplace services in accordance with applicable laws, and publicly disclose information about the website owner on the homepage.
- Develop and publicly publish on the website the operating regulations of the e-commerce marketplace; monitor and ensure the implementation of such regulations on the platform.
- Require Members on the e-commerce marketplace to provide information as prescribed by law when registering to use the Services.
- Implement inspection and monitoring mechanisms to ensure that information provided by sellers on the e-commerce marketplace is accurate and complete.
- Store registration information of merchants, organizations, and individuals participating in the e-commerce marketplace, and regularly update any related changes or additions.
- Apply necessary measures to ensure the security of information related to the business secrets of merchants, organizations, individuals, and the personal information of consumers.
- Implement timely handling measures upon discovering or receiving reports of illegal business activities on the e-commerce marketplace, including:
+ Prevent and remove from the Website any service information that falls within the list of prohibited services or services belonging to sectors or business lines prohibited from investment and business under applicable laws.
+ Remove information about services that violate the law within twenty-four (24) hours from the time a request is received from a competent state authority.
+ Cooperate with intellectual property rights holders to review and remove products that infringe intellectual property rights in accordance with the procedures published in the operating regulations of the e-commerce marketplace.
+ Issue warnings or refuse to provide services for a definite or indefinite period to individuals, merchants, or organizations that engage in unlawful business activities.
- Assist competent state authorities in investigating and handling unlawful business activities, as well as in resolving disputes and complaints:
+ Provide information about subjects showing signs of or engaging in unlawful acts on the e-commerce marketplace to competent state authorities upon discovery or receipt of such information.
+ Regularly update keywords in accordance with recommendations from competent state authorities and filter information by keywords before information on goods and services is displayed on the Website.
+ Receive and respond to information to resolve complaints, reports, and disputes related to the e-commerce marketplace via the E-Commerce Management Portal of the Ministry of Industry and Trade at online.gov.vn.
- Publicly disclose the dispute resolution mechanism for disputes arising during transactions on the e-commerce marketplace. When Candidates on the e-commerce marketplace have disputes with Employers or suffer harm to their lawful rights and interests, provide Candidates with information about the Employers and actively support Candidates in protecting their lawful rights and interests.
- Members may create an account when needed and post recruitment listings in accordance with regulations.
- Employers may use enhanced features of the Platform after paying service fees under the registered service packages.
- The right to request the correction or deletion of personal information when necessary.
- The right to refuse the processing of personal information for advertising or marketing purposes.
- The right to receive technical support and have information protected while participating on the Platform.
- Members have the right to provide feedback and suggestions to the E-Commerce Marketplace during its operation. Such recommendations may be submitted directly by letter, fax, or email to the CVTOT E-Commerce Marketplace.
- Provide CVTOT with complete and accurate information as required by law when registering to use the Services.
- Provide full information about the services in accordance with legal requirements when offering services on the e-commerce marketplace.
- Ensure the accuracy and truthfulness of information regarding services provided on the e-commerce marketplace.
- Comply with applicable laws on payment, advertising, intellectual property protection, consumer protection, and other relevant legal regulations when providing services on the e-commerce marketplace.
- Members shall bear full responsibility for the content and images of their business information and other information, as well as for the entire transaction process with partners on the CVTOT E-Commerce Marketplace.
- Not use another person’s account without authorization.
- Participate in transactions in compliance with the marketplace regulations and the Privacy Policy and Personal Information Usage Policy.
- Members are responsible for promptly notifying the CVTOT E-Commerce Marketplace of any unauthorized use, abuse, security breaches, and for safeguarding their usernames and passwords so that both parties may cooperate in handling such matters. Members warrant that all information provided to and posted on the CVTOT E-Commerce Marketplace is accurate.
- Candidates have the right to register a personal account on the CVTOT website to use the services provided by the system.
- Candidates have the right to have their personal information and application data protected by CVTOT in accordance with Vietnamese laws on personal data protection.
- Candidates have the right to access their personal accounts to view, edit, update, or delete personal information and application profiles at any time. In cases where operations cannot be performed on the system, Candidates have the right to contact CVTOT’s support department for assistance.
- Candidates have the right to refuse to receive advertising emails, recruitment newsletters, or other unwanted content from CVTOT through the unsubscribe options integrated into each email or via account settings.
- Candidates have the right to submit feedback and complaints regarding service quality, inaccurate recruitment information, inappropriate conduct by Employers, or any issues arising during the use of the Website. CVTOT commits to receiving and handling complaints as promptly as possible, in a cooperative spirit and with the aim of protecting users’ rights and interests.
- Candidates have the right to be clearly informed of the terms and conditions of service use, as well as the rights and obligations related to creating profiles, applying for jobs, and any legal bindings, if applicable.
- All information provided by Members on the CVTOT E-Commerce Marketplace must be accurate and complete.
- Members shall bear full responsibility for the content, images, and other information they provide, as well as for the entire transaction process with partners on the CVTOT E-Commerce Marketplace.
- Members shall not use another person’s account without authorization.
- Members shall participate in transactions in compliance with the marketplace regulations and the provisions of the Privacy Policy and Personal Information Usage Policy.
- Members are responsible for promptly notifying the CVTOT E-Commerce Marketplace of any unauthorized use, abuse, or security breaches, and for safeguarding their usernames and passwords so that both parties may cooperate in handling such matters. Members warrant that all information provided to and posted on the CVTOT E-Commerce Marketplace is accurate.
If any provision of this Terms of Service is declared invalid, the remaining provisions shall remain in full force and effect. This Terms of Service shall have the same legal validity as an electronic contract and shall take effect from the time the Member clicks the button “I agree to the Terms of Service”.
